Famiqo Terms of Service

1. Agreement to these Terms
By creating a Famiqo account or using the service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Famiqo. If you accept on behalf of your family, you represent that you are authorized to do so.
2. Who may use Famiqo; family accounts; parental responsibility
- Famiqo is a family account product. The person who creates the family is its administrator (admin) and must be 18 or older and a parent or legal guardian (or otherwise authorized to act for the household).
- The admin adds household members, including children, and is responsible for: obtaining any consent needed for those members; supervising children’s use; configuring children’s visibility and permissions; and the activity of the family account.
- Children may use Famiqo only under the supervision and with the consent of the family admin, consistent with the Privacy Policy (Section 8).
- You are responsible for keeping your login credentials secure and for activity under your account.
3. The service
Famiqo provides private family chat, a family wiki, scheduling (“Steps”), an AI steward (“Iqo”), and related features. We may add, change, or remove features. Some features described in our materials may roll out over time or depend on third-party services.
4. Acceptable use
You agree not to: use Famiqo for unlawful purposes; upload content you don’t have the right to share; attempt to access another family’s data; probe, breach, or overload the service; reverse-engineer or scrape it except as allowed by law; or use it to harm, harass, or endanger anyone, including children. We may suspend or terminate accounts that violate these Terms or that we reasonably believe create risk to users or the service.
5. AI features and the propose-approve-apply model
- Iqo is an assistant, not an authority. Iqo can be wrong, incomplete, or out of date. Its outputs are suggestions.
- High-impact actions require approval. Changes such as calendar edits, wiki publishes, adding contacts, or running automations are proposed to your inbox and applied only when a permitted member approves them. You are responsible for reviewing proposals before approving.
- Not professional advice. Iqo does not provide medical, legal, financial, mental-health, or other professional advice. Do not rely on it for decisions that need a qualified professional, and never rely on it in an emergency. In an emergency, contact local emergency services.
- Your inputs. Don’t enter information into Iqo or Famiqo that you are not permitted to process, and supervise what children share.
6. Your content
- You own your content. As between you and Famiqo, your family owns the content your family creates or uploads.
- License to operate. You grant us a limited license to host, process, transmit, display, and back up your content solely to provide and secure the service for your family (including the privacy-pipeline processing and the AI processing described in the Privacy Policy). We do not use your content to train third-party AI models, and we do not sell it.
- Responsibility. You are responsible for the content your family puts into Famiqo and for having the rights to it.
7. Privacy
Our handling of personal information is described in the Privacy Policy, which is part of these Terms. Famiqo pseudonymizes personal identifiers before content is sent to third-party AI models and processes voice on its own servers, as described there — but no method of transmission or storage is perfectly secure or perfectly de-identifying.
8. Plans, fees, and billing
Famiqo may be offered free during an introductory period and may later offer paid plans. If and when paid plans are introduced, pricing, billing cycle, trial terms, renewal, and cancellation will be presented at sign-up and processed by a third-party payment processor; this section will be updated accordingly.
9. Third-party services
Famiqo relies on third-party providers (listed in the Privacy Policy) and may link to or integrate third-party services. We are not responsible for third-party services, and your use of them may be subject to their own terms.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the service will be uninterrupted, error-free, or secure, or that Iqo’s outputs will be accurate or suitable for any purpose.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Fold and Flock LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100. Some jurisdictions do not allow these limitations, so they may not fully apply to you.
12. Indemnification
You agree to indemnify and hold Fold and Flock LLC harmless from claims arising out of your content, your use of the service, or your violation of these Terms, to the extent permitted by law.
13. Termination
You may stop using Famiqo and request account deletion at any time (see the Privacy Policy). We may suspend or terminate access for violations of these Terms, legal requirements, or risk to the service or its users. Provisions that by their nature should survive termination (e.g. ownership, disclaimers, liability limits) survive.
14. Changes to these Terms
We may update these Terms. For material changes we will notify the family admin before they take effect. Continued use after changes take effect means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws rules.
